Legalising an extension or works done without a licence

Legalising works done without a licence costs from €1,200 + VAT in fees, usually between €1,200 and €3,500. If the works comply with the local plan (PGOU), you apply for a legalisation licence with a project; if they do not comply and are more than six years old, the route is usually an AFO (asimilado a fuera de ordenación), a declaration in which the town hall recognises the building as it stands.

What the regulations say

If the works comply with the planning rules, they can be legalised with a licence at any time. If they do not, the town hall can act for six years from their completion (article 153 of Andalusia's planning act, Ley 7/2021 (LISTA)); once that period has passed, the route is the AFO, except on land where the infringement never becomes time-barred.

Will I be fined for applying to legalise?

Applying for legalisation does not in itself lead to a fine, but if the town hall already has a case open, the two have to be coordinated. We look at this in the diagnosis.

What if the works do not comply with the local plan?

If they are less than six years old, the town hall can order their demolition. If they are older and not on excluded land, an AFO is possible.
